You have a right to ask for all of the bills prior to going to court. If it's small claims, it's worth it to fight them. If nothing else, you can make an offer in court for paying over time. The important thing in going to court is a lot of these places try to charge credit card fees when they are not allowed to in many states. In Oregon, they can only charge to 9% unless you agree in writing to pay more. (And if you had no choice, like emergency surgery, then it was not legal consent.) How badly will a collection agency going after $28 hurt my credit?Crazy's advice is great for most debts....but not this time. 1) The collection agency is NOT going to try coming after this debt. They only get 30% of what they collect, and it's barely worth the cost of the phone calls and letters they will be sending you. They already spent a few dollars putting this on your credit report (if they did already). 2) Demanding validation will be worthless, as this is not a "black and white" issue. The cable company will insist you never returned the equipment, and you lost your receipt. End of case. 3) If you pay this debt and they leave it on your report as a paid debt, it will still hurt your score. My suggestion is you call the collection agency TODAY and offer to pay this off. They may not have even placed it on your report yet, and that's great. Get them to send you a letter agreeing not to place anything on your report in exchange for payment. If they will not agree, do not pay it. It makes no sense to pay the debt twice, and you will have ruined credit now. The very first thing you should do is to call the court clerk in the county that you live in and ask if there is anything filed in your name. If there is something filed in your name with the court and if the document they sent was a real court document, which would be a summons and a complaint, then you should request that they put it in writing that once you pay the settled amount then they will drop their suit against you. Then you 'need' to answer the summons and include their letter as proof that they have no further claim against you. If a court date is scheduled then you need to show up to back up your position. Be sure that you speak with a lawyer that is well versed in consumer credit. Sending a phony looking court document is a MAJOR violation. Has the collector provided proof (validation) to you that they have the right to collect the debt and that the amount they are trying to collect is the correct amount? Have you ordered your credit reports to see if they are reporting, and if they are then are they reporting without any inaccuracies? Have you asked them if they will remove what they are reporting on your credit reports once you pay the settled amount? (they may not agree to it but it never hurts to ask) Did they agree to put in writing that once you pay the settled amount that they will no longer try to collect any remaining amount and that they will not sell or transfer the account to another collector? As for the 1099c .. If a collector sends that form then the amount that they put on it MUST be for ONLY the defaulted amount that was owed to the original creditor before the account was charged off. There cannot be a single penny more added to it once the account had been charged off. If you make a settlement payment then the amount on the 1099c must be less that amount that you had paid to settle. For example, if the amount that you had owed the original creditor was $2000 .. you agree to pay $800 to the collector, and that is the amount that you pay, then the 1099c must show an amount of $1200 and no more than that. A collector cannot include fees or interest that accrued after the account was charged off on the 1099c and they cannot put the full amount if they had received partial payment. Since the account was charged off in Dec 2011 then you may still have paperwork from the original creditor showing the amount that you had owed before it was charged off. Also, you stated that you had a job loss last year. If you were insolvent during the year that the account was charged off then you may be able to file Tax Form 982 (I would suggest including documentation to prove your insolvency along with that form). If you were insolvent then you will probably not have to pay any extra taxes from that 1099c. I have included a link in the source box to the IRS where you can find an insolvency worksheet to crunch your numbers, and you might want to run your figures past your CPA.
